Two Brides and a Baby: Our Side of the Story - Silverbird Cinemas

Defamatory allegations of fraud against Silverbird Cinemas by Mrs Blessing Effiom Egbe with respect to the Movie - Two Brides and a Baby - The true position

It has come to our  attention  that a certain Mrs. Blessing Effiom Egbe has been making disparaging allegations of fraud and unethical practices against Silverbird Cinemas with respect to the exhibition of the movie ‘Two Brides and a Baby’ which was produced by her. The said Mrs. Egbe has gone to the extent of issuing a press statement dated 28/02/2012 and titled ‘Notification of scam and impending lawsuit’. She has also engaged in a campaign of calumny against Silverbird Cinemas on different social media geared towards inciting public hatred against Silverbird Cinemas. It has therefore become necessary to set the records straight in the face of what is obviously cheap blackmail by Mrs. Egbe. 



It is important to make it clear from the onset that Silverbird Cinemas does not have any direct business relationship with Mrs. Egbe. In its business as exhibitors of movies to the general public, Silverbird Cinemas deals only with approved movie distributors based on agreed contractual terms. This was not different in the case of the movie Two Brides and a Baby.



Silverbird Cinemas acquired the rights to exhibit Two brides and a baby from Okhma Global Limited run by one Ms. Mary Ephraim Ita whom we understand is the distributor for the movie and appointed by Mrs. Egbe. Based on the contract signed between Silverbird Cinemas and Okhma Global, it was agreed that the movie would  be exhibited at Silverbird Cinemas in Abuja, Port Harcourt, Uyo and Lagos. In all the period of the negotiation, Silverbird dealt directly with Okhma Global Limited to the exclusion of all other persons.



It was agreed between Silverbird Cinemas and Okhma Global Limited that the movie was to be exhibited for a minimum of three weeks and for such extended periods thereafter based on the performance of the movie. To this end, Silverbird Cinemas provided Okhma Global Limited with the movie schedules and sales report for each week in advance for the period that the exhibition lasted. When Silverbird Cinemas expressed its desire to extend the screening of the movie as provided for under the agreement with Okhma Global, it forwarded the movie schedule for the week spanning 27th January 2012 – 2nd February 2012  by email to Okhma Global through its contact person, one Ms. Victoria Agbor. The notification of the schedule which represented the apparent intention to exhibit the movie in the week referred to was never objected to, neither did Silverbird Cinemas receive any notice of termination of the Agreement.



It is therefore incorrect as it is being insinuated by Mrs. Egbe in her press release that the movie was shown beyond 13th January 2012 without her requisite knowledge and consent or that of Okhma Global.  Silverbird Cinemas has been in the business of exhibiting both local and international movies for quite a while and its integrity has never been questioned in such a despicable manner. Silverbird Cinemas maintains that it has fulfilled all its contractual obligations with respect to Two Brides and a Baby to Okhma Global which has not raised any issue with it. We would have expected therefore that Mrs. Egbe would have channelled her grievances towards her distributor (Okhma Global) rather than dragging Silverbird Cinemas into her private vendetta.



Silverbird Cinemas is therefore justifiably embarrassed by the contents of the Press Release as well as the various libellous publications instigated by Mrs. Egbe in different social media, blogs and websites including but not limited to her Tweeter account, Linda Ikeji’s blog and Nigeriafilms.com which seem to suggest that Silverbird Cinemas fraudulently made copies of the movie  to  exhibit illegally without the knowledge and consent of Okhma Global or that it has failed to make the necessary royalty payments for the exhibition to Okhma Global which it contracted with.



 Silverbird Cinemas views these serious allegations of fraud contained in these publications as unfounded, vexatious, defamatory and a deliberate attempt to smear its hard-won corporate integrity. As a responsible corporate organization , it abides with all the extant Codes of Corporate Governance and goes to great lengths to maintain transparency in all its corporate dealings. Mrs. Egbe’s indiscretion in going public with such unfounded and malicious allegations of a grievous nature as fraud despite explanations made to her to forward any reservations or enquiries she might have with the contract for the exhibition of the movie to Okhma Global has caused Silverbird Cinemas loss of business reputation and goodwill, as it is constantly inundated daily with calls by its business associates seeking to verify the truth of the allegations.



We have also noted the negative comments and conclusions reached by the general public on the websites, blogs and social media based on the stories published on the instigation of Mrs. Egbe.  We have therefore instructed our team of lawyers to undertake a review of the circumstances surrounding this episode and we may be constrained to commence legal action against Mrs. Egbe if she does not make a retraction of the defamatory statements she has made against Silverbird Cinemas along with an apology for her false and unfounded statements. Silverbird as an advocate of the growth and development of the Nigerian entertainment industry will continue to support the industry including Nollywood irrespective of the negative publicity.

We also urge members of the press to balance their reporting of this incident based on verifiable facts in line with the best ethics of journalism. Silverbird Communications Limited and by extension, Silverbird Cinemas has an open door policy towards media relations and is always available to make any clarifications on this issue that may be required. Dear Ben Bruce and Silverbird, do not open up a can of worms that will definitely expose your company and bringing international film companies which have been getting the short end of the stick since you opened your doors. Bottom line, you people need to go and find out why every Nollywood producer is praying for competition so they can stop dealing with your company. This release is nothing but a big old threat to shut Blessing Egbe up and we the Nigerian movie lovers will not stand for it.

We ask weak members of the producers guild who often suck up to rich people and politicians to get up and fight for the rights of the producer. You people know what has been going on and it needs to stop. Mrs Egbe was brave enough to speak up and now she is being threatened.

If I were Blessing I will subpoena the producers of Figurine, Tango with me, Champions of our Time, Anchor Baby, Dagrin, and so many others. Unless they have been bought, they will state that this company has under reporting issues.

Dear Silverbird Cinemas, 


You asked for it and I will give it to you. In reply to your stupid and patronising press release, I hereby ask, what planet are you on? What's with the press release? Court of public opinion is not a court of law. Get that into your thick head. You're putting the cart before the horse. You've come to the wrong platform for sympathy and air your grievances. Piss off and take your case elsewhere.


Is this what you lot do to each other and to defenceless people in Nigeria? From reading your £2 "press release", I'd say Silverbird Cinemas is deluded and a horrible and shameless bully. Shame on you Silverbird. Your press release is a clear act of victimisation and intimidation against Mrs. Blessing Effiom Egbe. 


If you as a corporation feel defamed by the actions of Mrs. Blessing Effiom Egbe or anyone, the right and proper procedure would be for you to use mediation procedure to settle the issues or table your grievances before a properly and lawfully constituted court of law, not use court of public opinion to tarnish and destroy anyone. Veghead, be careful or the destruction you are seeking to use social media to destroy Mrs. Blessing Effiom Egbe will backfire big time on you. Ps, do me a favour and take formal displinary action against whoever amongst you whose idea it was to wage online war against an individual. It was a stupid stupid stupid idea. Your options was peaceful and amicable settlement or to use the courts to shut down Mrs. Blessing Effiom Egbe's allegations. Even though you're a corporation, you wouldn't dare table your case in a court of law because you know that legal action would expose you as the one who infringed and undermined Mrs. Blessing Effiom Egbe's legal rights.


DON'T DO EVIL JUST BECASE YOU CAN. Your hatchet job disguised as "press release" should have been AFTER the success of legal proceedings against whoever you claimed defamed you. My name is Blessing Effiom Egbe and this is my direct reply to the statement put out by Silver bird cinemas (Claimed).
you say i made defamatory and untrue comments about you. To that i say "YOU LIE". Every phrase and sentence i made in my press statement is TRUE and TRUE and like i stated in it, i have every document to proof my claim. i am hereby re enforcing on every word in that press statement and by so doing i await your lawsuit.

when i discovered that my movie was still being exhibited by you beyond the time i was told it had stopped, i wrote to my distributor through my lawyers to come clean on the matter. we gave her three days to reply and she did not. we came to you as the exhibitors of the film to complain about the issue with my distributor and asked you to forward the true records to me as the copyright owner of the film. we gave you seven days to reply and you did not. we even wrote a followup letter to you as a reminder but you still didn't respond positively to our request. how was i then to know what you now claim? If you had as much as replied to us that you indeed informed my distributor of your intention to continue showing my movie, maybe the headline of the story would be different than what it is now. my distributor had informed me that all my film master hard drives had been collected from you. so how then did you get the copy which you used in showing. how was i to know when you bluntly refused to reply our letters. perhaps we are too much of a small entity for you to deal with.

let me just state here that, apart from my tweets and the press statement i put out, every other writings on the matter is based on people's deductions and perhaps opinions formed from previous happenstances; so please do not blame me for the negative reactions you have been getting. i remember seeing this film, nice movie

hmmm .... The buzz around Nolloywood film Producers is clear, there are & have been many under reporting issues From Silverbird cinemas.If you ask any producer that has sent his or her film to cinema they will tell you.

What needs to happen is a Class action suit all Producers of Najia films in cinemas (past & present) should get behind Ms Egbe & demand for all sales reports of all their films.

What i dont understand is this, when the Producer contacted Silverbird why didn't they reply or respond ? they could easily have given her the information in this press statement, with that information she would have known who to go after, the only thing that makes sense is that Silverbird had something to hide by not responding.

At the end of the day I blame d producers who decide to take their movies to d cinemas. I thot it was to curb piracy, but d cinema method doesn't seem to be working wit allegations here and there.
I remember bak in d day wen we cud go to video clubs and rent movies, or buy them frm d market. The fans made these A-list actors and actresses who they are today. Now, Genevieve and Co star in these movies dt get screened in cinemas only, effectively cutting out a large chunk of d populace dt will see it. Haven't seen any of these new nollywood movies, tango wit me, kiss and tell, 2 brides N a baby, damage etc.
Why? I'm not a cinema person and if I must go it won't be to go see a nigerian movie. Going frm comments after movies are screened, I think I'm ok in my assumption.
My advise to producers, release ur movies on DVD's. Jenifa was sold at N1500 for part 1&2, and pple still bought it. All these cinema paroles is apparently nt working. Blessing Egbe, I wish u luck

At the beginning of the statement, i thought they were leading up to unleashing facts and figures to back up their claims.However,it just ended up as a rambling threat letter written by an arrogant bully.Silverbird should answer the posers directly..Was the film indeed screened beyond the agreed dates? If so,did they make copies of the master tapes or neglect to return the original copies? Did they ignore her letters demanding an explanation thinking she was not worth the time? As the Lagbaja song goes,'answer simple yes or no'!

I for one think that Silverbird made a mistake by going ahead to extend a contract without any form of agreement for that extenuation from the other party. If you sent a mail to someone shouldn't you check first to make sure the person has gotten it? Silverbird shouldn't have assumed that the silence from the distributor ment a yes. Its funny and all these English is jargons.

Please comment with your brains and not your asses. Silverbird is 100% right. They legally do not know her and if she felt cheated by her distributor, she should not have made such press releases about silverbird because there was never a contract between her and silverbird.

The saying; be quick to think and slow to act would always save you from this kind of mess. She should be lucky if Silverbird ever takes any of her work in the future...

1.sales numbers of the movie for each week. I can bet the numbers for the first month are manipulated already.

Wait o, blessing egbe said her distributor did not respond after 3 days, neither did silverbird. So why did she choose too go after silverbird and not her distributor who is supposed to be her representative? This just reemphasizes the need for education in nollywood. Their diction and thesaurus is appalling, actors are just villagers with pretty faces, no training whatsoever. Take susan patrick's grossly uncouth reaction to the bb debacle. I also imagine they sell the rights to distributors upfront, as is the case in d music industry? Not sure sha

In all, she(blessing) is setting a bad precedence. This may dissuade silverbird from supporting nollywood and the likes of ini edo, rukky and uche jumbo know how that will prevent them from holding their red carpet movie premieres.

Personally I cannot pay 1,500 to go and watch nigerian movie, even 10k dstv to watch african magic is a waste but thats purely my opinion.

THE LEGAL DRAMA IN THE BLESSING EFFIOM-EGBE v. SILVERBIRD ET AL DISTRIBUTION CASE.

The assassination of people’s character in the Nigerian community, and apparently Nigerian owned businesses, when there is legitimate issue on the table is something I truly detest. Get to the point Silverbird. What’s with “despicable,” “calumny campaign,” “cheap blackmail,” “disparaging,” “inciting public hatred” comments throughout the release? Effiom-Egbe focused on the issues so please stay on topic.
The issue here is pretty straightforward. Did you or did you not have the consent and authority to extend the screening dates for ‘Two Brides and a Baby’ beyond the initially negotiated weeks? If you say you did, where is the legal agreement (proof) evidencing such authority? Also, where is the producer’s cut i.e. Effiom-Egbe’s money? Where are her master drives submitted?
Silverbird has simply not answered these questions. (Folks, you can sue a distributor and a cinema in situations like this, not just the distributor)
First, Silverbird says, “It was agreed between Silverbird Cinemas and Okhma Global Limited that the movie was to be exhibited for a minimum of three weeks and for such extended periods thereafter based on the performance of the movie.”
Fine. But Effiom-Egbe says she never agreed to such. Have you done the due diligence and can you provide a record evidencing such extension by Effiom-Egbe based on her agreement with Okhma? When did Effiom-Egbe agree to this and where is her signature evidencing such proof which caused Silverbird to rely on it to do business with Okhma? The intellectual property rights belong to Effiom-Egbe. If Silverbird negotiated outside of the scope of what Effiom-Egbe was willing to give, then that is so not her problem. Next time, have the distributor also have a signature on the agreement you sign showing that of the filmmaker and the conveying of whatever rights was to be obtained.
Silverbird attempts to paint a “we are an amazing company” picture to the public. And?? How does that get to the heart of the matter on the monies allegedly owed to Effiom-Egbe?

Silverbird, you have spoken and you only substantiate Blessing Effiom-Egbe’s claims. The issue at this point is payment. The deed is done. She just wants to get paid. Pay up! Tighten up your internal dealings with Nollywood filmmakers and keep it moving. The cost of litigation on both sides adds up. Further, Silverbird has more to worry about than Effiom-Egbe with bad media publicity that is archived indefinitely on google.

This whole drama could have possibly been avoided if Effiom-Egbe made it a condition in her distribution agreement to at least review a copy of all contract(s) to be signed, in her behalf , in the first place. Yes it is cumbersome and distributors might not want to deal. But, unless the distributor is taking the flak for any and all things that go wrong i.e. legal liabilities, Effiom-Egbe needs to see anything that will be signed on her behalf; and at a minimum, if a distributor does not agree to that, she needs to get a copy of the agreement signed with the Exhibitor if it legally binds her, which most do anyway in one form or another.

Get your facts right. Blessing Egbe did not go after silver bird alone. go read her statement. she went after the distributor. when the distributor didn't reply, she went to the s. ozone. genesis and Silver bird to furnish her with what the distributor refused to give her. only Genesis replied her. Silver bird is taking the heat because they were the ones that showed it beyond the agreed time. they showed it for longer than the agreed period. also it was silver bird's ticket she published as evidence and people came hard on them. the facts were stated. she is suing the distributor and all the cinemas. only silver bird knows why they are taking the piss.

since mrs ogbe didnt have a direct contact with the silverbird management to showcase her movie, she has no business with silverbird, she should chanel her complaints to the intermidiary.......

This is sad...if Blessing actually took the steps she stated above, then it is indeed terrible. I think Silverbird cinema, for what it represents, should have found a way to deal with this issue before it got this bad. It doesn't take anything for them to have called the Oklma or what it is called to have ironed this out.
The issue with some Nigerian enterprises is that they give no consideration to their stakeholders, all they want is money, money, money and think less about building and maintaining brand loyalty.
When you are in business, somethings matter more than "cash" and that's perception, it can make or mar you Silverbird. It doesn't matter that you are right or wrong, you've got a name to protect.

I dont see any problem about all this. I dont expect Mrs Egbe to reply Silverbird again. Silverbird has not come out to deny showing your movie up till certain time, even though Mrs Egbe herself admit same. Now that Silverbird agrred they exhibited the movie beyond the time Mrs Egbe had in mind, all the parties need to do is allow Silverbird pay you up till the time they stopped. Having said this, nobody is mentioning the fact of whether Mrs Egbe deal directly with Silverbird or not, and has Mrs Egbe saw a copy of the contract agreement between her marketer and Silverbird? Can she confirm whether Silverbird actually entered into this agreement and have the right to show the movie beyond the time she is claiming? If indeed there was a signed contract agreement to the exhibitions of the movie between Silverbird and Okhma Global, then Mrs Egbe should deal directly with her Marketers, and by her latest press statement, she admitted writing her marketers to that effect which means Okhma Global actually represented her interest in the matter. Now, has anyone heard any same story of this nature in the past as regard Silverbird?, if not, then Mrs Egbe should tread carefully because Silverbird had been dealing with a lot of exhibitions of movies for a while. Now, how come none of those that publish the story did not deemed it fit to cross check the allegations with Silverbird?

SALES REPORT FROM OKHMA INFORMED HER CLIENT THAT CINEMAS ACROSS NIGERIA HAD STOPPED SHOWING THE MOVIE AS AT MID JANUARY.

IT WAS DISCOVERED THAT SILVERBIRD CINEMAS AS AT FEBRUARY 2012 WAS STILL SHOWING HER FILM WHICH OKHMA EXCLUDED OR FAILED TO REPORT AFTER REPEATED QUERY FROM BLESSING ON THE MATTER.

BLESSING WROTE TO HER ERSTWHILE AGENT OKHMA FOR EXPLANATION AND ALSO REQUESTED A COPY OR COPIES OF CONTRACT SIGNED WITH THE CINEMAS ON HER BEHALF.

OKHMA HER AGENT REFUSED.

AS A RESULT BLESSING WROTE THE CINEMAS EXPLAINING THE ISSUE WITH HER AGENT AND THE APPARENT BREAKDOWN IN COMMUNICATION, TO THAT EFFECT SHE REQUESTED FOR DIRECT CINEMA SALES REPORT TO ENABLE HER AUDITORS VERIFY REPORTS WITH WHAT HER ERSTWHILE AGENT HAD GIVEN HER.

CINEMAS REFUSED TO RESPOND.

SHE WROTE A REMINDER TO THE CINEMAS AND THEY STILL DECLINED ON HER REQUEST.

HER AGENT OKHMA THEN WROTE TO BLESSING STATING THAT SHE DOES NOT HAVE THE PRIVILEGE OF SEEING THE CONTRACT SIGNED WITH THE CINEMAS ON HER BEHALF.

AT THIS POINT BLESSING RELEASED A PRESS STATEMENT ON WHAT HAD TRANSPIRED.

FROM BLESSINGS PRESS RELEASE I HAVE READ SHE HAS NOT YET ACCUSED SILVERBIRD OF ANYTHING.

WHY IS SILVERBIRD NOW MAKING ALL THIS NOISE WHEN THE SAME LETTER WRITTEN TO IT WAS WRITTEN TO OTHER CINEMAS.

i have read all press statements involved in this matter. Blessing has a case. but i think people are failing to see the biggest culprit here. the thief of a distributor called MARY EPHRAIM ITA. Blessing if i were you, i will write to all the people she deals with. both international and local and have them know what big a thief she is.

All l i see in this case is the manipulations of Mary Ephraim Ita. the distributor. she wanted to play a fast one with Two brides and a baby, same way she does with international movies but i guess she met with the wrong filmmaker this time around.. i don't know why silver bird is swallowing pills on her behalf. abi something dey dia?
