Paul Play slams Etisalat with N200m copyright infringement lawsuit

Singer Paul Play Dairo has filed a N200m lawsuit against telecommunications company, Etisalat for using his song, Mosorire in its popular reality series, Nigerian Idol, without seeking his consent. In the suit filed at a Lagos High court and marked FHC/CS/581/2014, Optima Media Group was made co-defendant. Paul stated that the defendants had used his hit song, Mosorire, which he composed himself, to promote their TV show, Nigerian Idol in 2012 and 2013.

He alleged that during the course of the programme, a contestant was made to reproduce his song and sing it without his express permission as the owner of the song.
The court paper in part reads
"I am the copyright owner of the work named and tagged “Mosorire”, contained in my repertoire, exclusively for the jurisdiction of Nigeria and the authority or permission to exploit such work can only be obtained from me. However, the defendants being an organiser of a television reality show tagged, “Nigerian Idol” caused the use, adaptation and deployment of my said work titled, “Mosorire” on the said show without my consent, and which was broadcast to several millions of television viewers throughout the Federal Republic of Nigeria and the rest of Africa for 2012 and 2013 editions.”
Paul Play said that as a singer and composer, he was entitled to an annual fee of N100m on the track. He said for having made use of his song without reaching out to him for permission, the defendants, Etisalat and Optima media group had made him loose some money while according to him, they "made gains and improved on their own brand image.”. No date has been fixed for the hearing.

Now this is what you call a frivolous and baseless lawsuit! Yes, they gained, but how did he lose?! Ask him now to show evidence of losses he made as a result of the show using the song and he would not be able to show or prove anything! He must be very broke sha, poor guy!

I KNOW ABOUT THIS SUIT AND OGA PAUL IS SERIOUSLY MISGUIDED.

1.COPYRIGHT LAWS ARE CLEAR ONCE A SONG IS IN THE PUBLIC DOMAIN. MEDIA HOUSES MAY USE WITHOUT CONSENT BUT SHOULD ENSURE THEY PAY COMPENSATION.
2. THE COMPENSATION TO BE PAID IS DETERMINED BY THE CATEGORY OF USE . IN THIS CASE THE USE IS CATEGORIZED AS MINIMAL NOT LIKE ADVERT GINGOS OR COVER VERSIONS.HIS SONG WAS ONE OF MANY SONGS WHICH FORMED A LIBRARY OF SONGS GENERATED FOR THAT SHOW IN THEIR HUNDREDS
3 ALL OPTIMA NEEDED TO DO WAS CLEAR WITH THE APPROPRIATE COLLECTING AGENCY. THE LAW DOES REQUIRE THEM TO SEEK CONSENT FOR ALL USED WORKS BOTH LOCAL AND INTERNATIONAL
4 NOW IF OPTIMA HAD PAID ROYALTIES TO THE COLLECTING AGENCY. THE ROYALTY IS DIVIDED AMONGST ALL THE SONGS USED TO ALL PARTIES WITH RIGHTS IN THAT WORK.ARING IN MIND THAT SOME WORKS HAVE MULTIPLE OWNERS AND MULTIPLE RIGHTS. (PUBLISHING RIGTS SONGWRITER RIGHTS SOUND RECORDING RIGHTS E.T.C)
5 AM AWARE OPTIMA PAID ROYALTIES AND PAUL PLAY WAS GIVEN HIS BIT.

6 MOROVER MOSORIRE IS NOT HIS WORK ITS HIS FATHERS WORK . HE DID A COVER VERSION. SO DOES NOT HOLD ORIGINAL SONGWRITERS RIGHTS TO THE SONG. HE DID NOT WRITE THE LYRICS. SO UNLESS HE CAN SHOW DOCUMENTS TRANSFERRING RIGHTS IN THE SONG TO HIM. HE NEEDS TO JOIN HIS FATHERS ESTATE IN THE SUIT AS PRINCIPAL RIGHT OWNERS. HIS RIGHT TO THE WORK IS SECONDARY. ITS NOT AS SIMPLE AS HE THINKS IT IS.

7 THE CASE IS DEAD ON ARRIVAL.TOO MANY ODDS. BUT LOOK ON THE BRIGHT SIDE . AT LEAST HE GOT PUBLICITY NEGATIVE OR OTHERWISE. NOW NOBODY WILL WANT TO GO NEAR HIM . HE NEEDS SOME SERIOUS PR HELP . CAUSE HE JUST COMMITTED PR SUICIDE.

Shortman said...

guy no gree them i get lawyer if you want..all join.

Unknown said...

Too broke o.So na like dat d guy won take make money does he think its easy?

Anonymous said...

Some pple just show how stupid they are. You must not comment on everything especially the ones u don't understand. the guy's got his right to sue them if they did not contact him officially. these expatriates always take us for granted cos we don't know our rights. think its high time we got things right in this country. u clueless and silly pple should quit insulting this guy

Anonymous said...

Thank you @awesome slim.. @Salsa @obednwafor and co hope u guys re learning

Anonymous said...

Pple just talk any how, being broke is nt d issue, its his right. They should hv at least contacted him, the song wasn't done for charity. You can't spend ur time and resources to create a product and it gets used without following the due process. That can be likened to theft, they wr not willing to pay hence dey went ahead to make use of the song without his consent. Most pple who coment know notin, pple can be so judgemental. But then again, that's life. What ever you do, pple must talk.

NowConfirmNews said...

hahahahaha hungry don beat am.... go look for somthing do bro

Unknown said...

Hahahahahaha Brokeass trying to look for a way to get some money.

Anonymous said...

Don't be ridiculous! It doesn't discount the fact that his music was used without his consent. Even dead celebs like Elvis and Michael Jackson estates still get royalties for the use of their music. Not placing him in that calibre but it is the law whether you think he is broke or not.

Anonymous said...

And? Even musicians dead and living who had songs out in the 50s/60s still have to grant permission for their works to be used, so your point is invalid.

Anonymous said...

Well, maybe they are written them before and wanted them to settle out of court but Etisalat is proving to be stubborn/or the offer the came back with was not satisfactory, hence him going ahead with the suit?

Anonymous said...

Great. Thanks for your the clarification on copyright law. Very informative.
